1. Introduction and Acceptance of Terms

These Terms and Conditions (“Terms”) govern your use of the website drinkworkshop.com (“the Website”) and the booking of workshop services (“the Services”) provided by Phillip Thomas trading as The Drink Workshop (“The Drink Workshop,” “we,” “us,” or “our”). By accessing the Website, Browse its content, making a booking, or using any of our Services, you agree to be bound by these Terms and Conditions, our Privacy Policy, and our Cookie Policy. If you do not agree with any part of these Terms, you must not use our Services.

3. Scope of Services

The Drink Workshop offers interactive Hierbas liqueur and Gin workshops as described on the Website. These workshops involve the history, culture, and hands-on creation of Hierbas liqueur, and the hands-on creation of making gin.

4. Booking Process

4.1. Online Booking: All bookings for our workshops are made through the online booking system available on our Website, powered by Amelia Booking and WooCommerce. 

4.2. Reservation: To reserve your place in a workshop, you must select your desired date, time, location, and number of participants, and provide all required personal and billing information. 

4.3. Confirmation of Contract: A binding contract for the provision of Services is formed only upon successful payment and our issuance of a booking confirmation email to the email address you provide. This email will contain all the details of your booking, including date, time, location, number of participants, and booking reference.

5. Pricing and Payment

5.1. Pricing: All prices for our workshops are stated in Euros (€) on the Website. Prices include VAT (IVA) where applicable. 

5.2. Payment Methods: We accept payment via Stripe and PayPal as specified on our checkout page. 

5.3. Payment Due: Full payment for all workshop bookings is required at the time of reservation through our online booking system. Your booking will not be confirmed until full payment is received. 

5.4. Payment Processing: Payment transactions are securely processed by our third-party payment gateway providers (Stripe and PayPal). We do not store your full payment card details on our servers.

6. Workshop Participation and Age Restrictions

6.1. Participant Conduct: Participants are expected to behave in a respectful manner towards the workshop host, other participants, and the venue. The Drink Workshop reserves the right to deny participation or remove any individual who is intoxicated, disruptive, or acts in a manner that may compromise the safety, enjoyment, or integrity of the workshop. No refunds will be given in such circumstances. 

6.2. Following Instructions: For safety and optimal experience, participants must follow all instructions provided by the workshop host. 

6.3. Health and Allergies: Participants are responsible for informing The Drink Workshop of any relevant allergies, health conditions, or dietary restrictions that may affect their participation or interaction with workshop materials or ingredients. 

6.4. Age Restriction: Due to the involvement of alcohol, all participants must be 18 years of age or older on the date of the workshop. Proof of age may be required. The Drink Workshop reserves the right to deny participation to anyone unable to provide valid proof of age if requested, with no refund given.

7. Cancellation Policy (by Customer)

7.1. Standard Bookings: You may cancel your standard workshop booking for a full refund at any time up until 24 hours prior to the scheduled start time of the workshop. After this 24-hour period, no refunds are possible for cancellations. 

7.2. Private Bookings: Deposits for private bookings are refundable up to 7 days prior to the scheduled start time of the event. After this 7-day period, deposits become non-refundable. 

7.3. Participant Substitution: If you cannot attend a standard workshop, you are permitted to have someone else go in your place. Please notify us of any name changes as soon as possible. 

7.4. Change of Date/Time by Customer: Changes to your standard workshop booking date or time are permitted up to 24 hours prior to the scheduled start time, subject to availability. Please contact us to arrange a change. 

7.5. Change of Name/Participant by Customer: You are permitted to change the name or participant on your booking at any time by notifying us.

8. Cancellations and Changes by The Drink Workshop

8.1. Minimum Participant Requirement: The Drink Workshop requires a minimum of 4 people for a standard workshop to go ahead. Should this minimum number not be met 12 hours prior to the workshop, you will be offered an alternative workshop day. If you are unable to attend the alternative day, or if no suitable alternative is available, the workshop will be cancelled, and you will be refunded in full. 

8.2. Venue Changes: The Drink Workshop reserves the right to change the location of the workshops should our normal venue become unavailable due to unforeseen circumstances. We will notify you of any such changes as soon as reasonably possible and ensure the alternative venue is of comparable quality and accessibility. 

8.3. Cancellation Due to Unforeseen Circumstances (Force Majeure): If, for any reason beyond our reasonable control (e.g., severe weather conditions making travel unsafe, natural disasters, unavoidable venue issues, illness of the host), The Drink Workshop needs to cancel a workshop, you will be notified as soon as possible. In such cases, you will be offered the option to reschedule your booking or receive a full refund. 

8.4. General Cancellations by The Drink Workshop: If The Drink Workshop needs to cancel a workshop for any other reason, you will be refunded in full.

9. Last-Minute Bookings

Should you wish to take part in a workshop at the last minute, we may be able to accommodate you, subject to availability. We strongly recommend booking in advance to guarantee your place. For very last-minute bookings within 4 hours of the start time, please contact us directly first to confirm availability and ensure we have enough materials.

10. Intellectual Property

All content, materials, recipes, instructions, and designs provided during the workshop or made available through our Website (including text, graphics, logos, images, audio, video, and software) are the intellectual property of The Drink Workshop or its licensors. These materials are for your personal, non-commercial use only. Reproduction, distribution, modification, or public display of any part of the materials without our express written permission is strictly prohibited.

11. Limitation of Liability

11.1. The Drink Workshop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; or (iii) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage. 

11.2. In no event shall the total liability of The Drink Workshop for any claims arising out of or in connection with these Terms or the Services exceed the total amount paid by you for the specific workshop booking giving rise to the liability. 

11.3. We are not responsible for any loss or damage to personal belongings brought to the workshop venue. Participants are advised to keep their belongings secure.

12. Data Protection (GDPR)

We collect and process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR) and relevant Spanish legislation. Our Privacy Policy details what data we collect, why we collect it, how we use it, who we share it with, and your rights regarding your personal data. 13. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Eivissa

14. Online Dispute Resolution (ODR Platform)

As a business operating online in the European Union, we also provide a link to the European Commission’s Online Dispute Resolution (ODR) platform. 15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and The Drink Workshop regarding your use of the Website and Services.

17. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
